Why Apple Dropped its App Store Name Fight With Amazon

In January 2011, I wrote about my belief that an app store is an app store and both the terms app and store are generic meaning together they become yet another generic term. Certainly the nuances of the legal system make my assertion a bit basic but having lived through a similar lawsuit which was eventually settled based on the fact the plaintiff must have realized the terms they were suing over were generic as well.

At the time, the post I penned was about Microsoft being sued by Apple for using the term app store – then more recently I wrote about Apple suing Amazon over their use of the same term for their store.

My feeling was the case would settle with Apple using “Apple App Store” & Amazon using “Amazon App Store.” Seems the case “settled” without the need for this to happen as the parties agreed to walk away from the suit which is really a smart move on Apple’s part because it is really difficult to prove app store is not generic when going up against Amazon’s virtually unlimited legal funds.

Americans Don't Know They Want Wearable Tech Yet

Recently a headline stating that most Americans don’t want wearable tech caught my eye and reminded me of many past of articles regarding consumer choices which were just plain wrong. The piece can be summed up with the following paragraph:

The April telephone poll of 1,011 Americans 18 and older found that only 34 percent of those polled who make $100,000 or more a year would consider buying or wearing a consumer-grade smart watch or smart glasses. For those with a significantly smaller income, $35,000 annually, the percentage of those interested in the technology increases to 47 percent.

The implication of the headline is the wearable market will remain a niche and while this could very well be the case, the reality is consumers and analysts have no idea where markets which haven’t been invented yet will be in the future.

How Nordstrom Has Adopted The Latest Technology

For about two decades we have heard about the death of brick-and-mortar at the hands of technology like the Internet but Nordstrom’s is one retailer who seems to be embracing many aspects of technology in order to boost sales not only online but in its stores. For example, in May of this year it was revealed that the company was working with a company called Euclid in order to track customer movements throughout the store using the company’s WiFi network.



In February of 2007, the company acquired online flash sales site HauteLook for $180 million and more recently rolled out a HauteLook app which has accelerated the company’s sales.

In the online world, Nordstrom is doing well with over four million Pinterest followers.

Yealink SIP T-38G Review

The Yealink SIP T-38G Gigabit color LCD PoE IP phone is another impressive IP phone following in the steps of the Yealink T-28P that Tom Keating reviewed in 2010. Tom liked the 4-way arrow navigation keypad, which continues on the T-38G, making navigating on the color screen a breeze. The T-38P also features a very similar web admin page as the T-28P and like Tom I had no trouble adding the SIP credentials, configuring the NTP server, adding speed dials, and other various configuration options.

While referencing Tom's T-28P review for comparison to the T-38G, Tom has this noteworthy comment:
The web interface displays a message when the phone is registered so you know immediately if you put the SIP credentials in correctly. I have to say, I really loved how every change I made DOES NOT require a reboot.

Communications service providers are at war with OTT providers and need to ensure they are able to battle on as level a playing field as possible. There are significant costs associated with running a major telco and hardware infrastructure certainly ranks high among them. Sure, OTT providers like Skype and WhatsApp have infrastructure costs as well but they often leverage standard servers and software to achieve their goals.

For many years now I have waxed poetic about the need for Apple to create a large screen phone. With the latest iteration of the iPhone, the “5” they decided to elongate the device but not make it wider. To me, this mistake is the worst that Apple has made since ignoring the market for seven-inch tablets and then playing catch-up with the iPad mini.

At first, when asked about larger screen phones, Apple said that they didn’t fit in the hand.

Does Bezos' Money Present an Objectivity Problem for Business Insider?

I am left wondering if there will be any perceived objectivity issues as a result of the $5M investment by Jeff Bezos in Business Insider. Like Jeff, I am a big fan of Business Insider… Henry Blodget and his team do great work.

I also can’t help but wonder how the coverage on the site may potentially change. Will we see as many stories critical of Amazon?

Advertising - A Key Part to Samsung's Success

Being in the tech field I often get to speak to lots of engineers who explain to me they aren’t swayed by advertising. Quite often they tell me they don’t think people in general are swayed either. What they do is project their personal feelings on a broad population which is normal.

Many of these engineers run tech companies which typically don’t do so well.

Google Blocking Apps Blocking Ads

Want to find the latest ad-blocking software for your Android device – sorry, you won’t be able to find them in the Google Play store. You see, the company decided that these programs do not comply with its Developer Distribution Agreement. Of course the argument could be made that they never did – in other words, ad-blocking is not new and having them listed in the company’s store isn’t a new development either. Obviously Google which is in the advertising business realized they shouldn’t allow a company which keeps it from generating revenue to take advantage of the app store they host.

Thank You Amazon, Retailers May Now Merge at Will

When reports surfaced regarding Office Depot merging with OfficeMax, the first thing which may have occurred to many, is regulators wouldn’t let this approximately $2 billion happen because the resulting store would be too large and create antitrust concerns. Much of these worries in retail however have decreased as of late because of the strength of Wal-Mart, Costco and of course Amazon. Let’s also remember that Staples is a major player in the space. It’s worth pointing out that Amazon in particular can be used by just about all retailers to justify industry consolidation.
