Here is a radio interview from NPR with Robert Mueller, director of the FBI. One of the points of interest from the interview is that they must adjust to the latest technologies like disposable cell phones, and VoIP. As he says, it is technically and legally challenging to monitor IP telephony. Apparently they are getting some cooperation in VoIP monitoring.

New technology constitutes a stronger enforcement. What I mean is that with advancements, abusers will surface eventually. Security for the safety of the citizens must co-exist with the technology. Adjusting is the right terminology to use, but the fact is that elected officials must have their hands on it before the consumers. Why? So they can understand what they are dealing with and tweak the bugs to make sure the security and safety of the citizens will not be breached. VoIP is one of the waves for technological advancements. The FBI is on the right track to understand the structure of VoIP in order to enforce safety.
