Merger Conditions for Comcast

TMC has the Comcast-NBC merger fully covered - here, here, here, here and the story of Congresswoman Waters.  Waters wants a written plan for diversity included in the merger paperwork. Without teeth, Comcast could write anything down. Where's the enforcement coming from?

Broadsoft's Second Offering

Broadsoft investors are cashing out to the tune of 4.8 million shares to be priced at $22 according to TradingMarkets.com. Today, BSFT is trading at $26.

In other news, Tampa-based Microsoft partner, Tribridge bought Mercatus Group, a health care provider practice systems integrator.

More consolidation in the UC/Hosted PBX space per press release: Vantage Communications, the premier provider of hosted Unified Communications services, has announced it has acquired the assets, technology and customer base of Digital Ingenuity, a long established Philadelphia based VoIP Provider.

Comcast-NBC Merger is Failure Two

This will be a far reaching rant but I think that it's time the FCC (and other F-Agencies) close their doors. Really. We have a huge deficit and really you just aren't honoring your duties or worth the expense any longer.

The Net Neutrality issue went on for months - and you had plenty of time to talk to the bazillion lobbyists, but couldn't find time to consider the consumer in all of this? 

Tele-Pacific Looking Wireless

TelePacific Communications, the largest California-based CLEC providing integrated voice and data telecommunications services to the small and medium-sized business ("SMB") customer segment in California and Nevada, and MegaPath Inc., the leading provider of managed IP data, voice, and security services in North America, today announced a definitive agreement for TelePacific Communications to acquire MegaPath's NextWeb, Inc. subsidiary, dba Covad Wireless, a broadband fixed wireless carrier operating in California and Nevada.

Under the terms of the agreement, TelePacific Communications will gain approximately 3,500 profitable broadband fixed wireless business customers in California, Nevada and suburban Chicago through an all cash purchase of capital stock, per the press release. The footprint is complimentary so that helps.

This move just adds to the wireless moves that Tele-Pacific has made this quarter.

FCC Net Neutrality

Copps and McDowell are on opposing sides of the Net Neutrality rules, which have still not been released to the public (and probably won't be until next week).

McDowell thinks that there is competition. This from the former lawyer at COMPTEL. He knows that there isn't competition -- it's what paid his salary for 10 years at COMPTEL.

Let's Clear Up AT&T 4G

So AT&T bought more 700 MHz spectrum; this time from Qualcomm for almost $2B. This was Qualcomm's spectrum from its FloTV project that used analog TV spectrum. In 2007, AT&T skipped the FCC spectrum auction to pay $2.5B for 700 MHz spectrum from Aloha Partners. [Phonescoop has a map of the 700 spectrum.]  So AT&T is shoring up 700 MHz spectrum for its 3G and later 4G/LTE service. VZW bought spectrum in the last FCC auction in the 700 MHz sector, but it came with a stipulation for open access.

EarthLink Wins One

It looks like EarthLink won the auction for ONE Communications, the CLEC with a HQ in New England and network in Mid-Atlantic, Midwest and New England. EarthLink will pay $370M for ONE including $285M of debt.

EarthLink Business will end up as the combined operations and network of New Edge Networks, Deltacom and ONE.

This acquisition is good for EarthLink because there isn't that much overlap. Deltacom gave them the Southeast; ONE gives them the Northeast.

Again this morning when discussing the new name, EarthLink is linked to consumer dial-up in the marketplace. How does that translate into a B2B Brand?

PAETEC subsidiary Paetec Software Corporation, bought Formula Telecom Solutions Inc. for $13 million in cash, according to this release. PAETEC is just buying the billing platform it has used for over ten years. Makes sense. And $13M for a BSS system is nothing.

What does it take to run a successful VoIP services company? According to Report Linker, "the biggest VoIP providers are ostensibly run-of-the-mill telecom companies. This means smaller providers must innovate and take the role of pioneers whose marketing strategy doesn't rely only on offering the lowest price, since that's a game they can't win."

Lowest price is about scale.

Broadband Numbers Fall

Broadband deployment numbers will fall. Why? The FCC has re-defined broadband as 4MB x 1MB and most DSL and 2.5G/3G do not provide that kind of real bandwidth. In the FCC report titled "Internet Access Services: Status as of December 31, 2009," 68% of connections in the US advertised as "broadband" can't really be considered as such because they fall below the agency's most recent minimum requirements." Oops!

What to Do With a Certified Agent?

On the Board call for the TCA (Technology Channel Association) discussing the the next step in the evolution of the Certified Telecom Professional (CTP).

The exam (and certification) is just $199 for member agents (and member VAR's) of TCA. Employees of our Vendor members (Motorola, Qwest, Megapath, Global Crossing, Intercall, XO, Level3, Netwolves, Star2Star, US Signal, Telnes Broadband and SalesStream) can also take the exam.

There has been a groundswell of buzz around the certification. The next step is to get carrier support for the CTP.

So Salesforce bought a Ruby based cloud platform company called Heroku for $212M, which my RubyonRails geeks say is a steal. Why? Marc Benioff, chairman and CEO, salesforce.com, says: "Ruby is the language of Cloud 2, and Heroku is the leading Ruby application platform-as-a-service for Cloud 2 that is fueling this growing community.

Sub-Agent Basics

I received an early morning call from the West Coast today from a woman who is a sub-agent selling Sprint mobile services. She's not having a good day. Here's a few reasons why:


  1. She isn't getting paid from her master agent.
  2. She doesn't have a contract in place with her master agent.
  3. She was unaware of charge-backs.
  4. She has no way to track commissions.
  5. She was not clear on who she could sell Sprint mobile services to.

Hence, her not getting paid.

There's been some buzz this week about the FCC's Internet Policy. We have a couple of problems in America right now: not enough broadband competition and not enough broadband. Without competition, the monopoly ISP doesn't have to build out (see Embarq in Hardee County, FL for an example). Without competition, prices are inflated.

Today, there are over a thousand companies selling voice services. It comes down to what your Value Proposition is.

Clients say they want to save money, but really they want reliable, quality dial-tone.
