Payin' The Cost To See "The Boss": Woman Sues StubHub, eBay Over "Illegal" Springsteen Concert Tix Scalping

Fervent Bruce "The Boss" Springsteen fan Sharon Fehrs doesn't thing that online ticket reeseller StubHub.com  and its corporate parent eBay are being fair.

As a result, she has just filed a class-action lawsuit against StubHub and- you guessed it- eBay.

Fehrs, of Portland, Oregon, begain this journey in December, when she logged on immediately after Springsteen tickets went on sale for his March 28 show in Portland. Fehrs had requested four seats up front.

Which, BTW, if you've ever seen Springsteen, that's the place to be.

Although she logged on almost to the nanosecond that tix supposedly went on sale, all she found was one ticket.

Things got real funky when, just minutes later, she logged on to StubHub to find choice Springsteen tix there for far in excess of their $95 face value.

Only one problem. StubHub is a reseller, and the city of Portland has some of the nation's strongest anti-scalping laws.

Portland's anti-scalping ordinance prohibits anyone from reselling tickets for events at the Rose Garden and city-owned venues for more than the ticket's original retail price. Violators face a maximum $500 fine and six months in jail.

So, as the Oregonian newspaper of Portland reports, Fehrs filed a class-action lawsuit  in Multnomah County Circuit Court in Portland, allegeing both companies violated the city of Portland's little-enforced anti-scalping law. She's asking the court to stop StubHub's practice and award damages to customers who opt into her lawsuit.

"She believes that StubHub and eBay operate an illegal secondary market that deprives people of an equitable opportunity to buy tickets at a reasonable price," said Fehr's attorney, John Neupert of Miller Nash in Portland.

As for their part, StubHub says they are not a reseller, but a platform for such transactions.
