RIAA Lawsuit Judge: You Have 30 Days To Provide Us With More Info
A U.S. federal judge has deferred Tanya Andersen's malicious prosecution lawsuit against the RIAA and infosleuthing firm MediaSentry.
Judge Anna J. Brown gave Andersen 30 days to better define her complaint with information about what laws the recording industry body and MediaSentry are supposed to have violated.
Andersen had filed suit against the RIAA after the body had withdrawn a file-sharing lawsuit against her. She had acccused the RIAA of intrusive tactics, such as contacting her daughter at school without her permission. Her attorneys accused the RIAA of negligence, fraud and libel.
As to the request for more information, ArsTechnica reports that Judge Brown said that Andersen had "not adequately stated claims for relief," but gave her until March 14, 2008, to file an amended complaint. Lory Lybeck, Andersen's attorney, told Ars that he plans to refile and move ahead with the lawsuit. "The judge spent about 45 minutes to an hour discussing exactly what she was looking for in an amended complaint," Lybeck said.
