FTC Gets Restraining Order Against Weight-Loss Spammers

October 11, 2007

The U.S. Federal Trade Commission has obtained a restraining order banning a company  from sending spam and making unsubstantiated weight-loss claims in those unsolicited emails.

The company, Spear Systems Inc. of Wyoming, which does business as eHealthyLife.com, was ordered to stop these practices by a Judge in the U.S. District Court for the Northern District of Illinois, Eastern Division.

The entity was charged with making false statements that their products would effect permanent weight loss of up to 25 pounds a month.

Additionally, the firm was found guilty of violating the CAN-SPAM act of 2003 by sending emails with false "from" addresses with deceptive subject lines.

A further hearing scheduled for today will explore an extension of the restraining order, as well as if the accused company should forfeit their profits made from the accused transgressions.
