Student Files Lawsuit Against RIAA File Swap Discovery Process
Ars Technica reports that Boston University student Ray Beckerman has filed a lawsuit against the Recording Institute Association of America' s practice of filing John Doe lawsuits to discover names associated with IP addresses of computer users who may be swapping files illegally.
The case has been filed in the US District Court of the District of Massachusetts.
"The motion seeks to have the RIAA's ex parte discovery order vacated, which would prevent the record labels in Arista v. Does 1-21 from learning the identity of the IP addresses flagged by MediaSentry from Boston University," reports ars technica's Eric Bangemann.
The motion maintains that there is no prima facie evidence of copyright infringement occurring and argues that U.S.courts have "disfavored" allowing expedited, ex parte discovery in such John Doe complaints.
